1. Who we are

Owen Music Theory ("we", "us", "our") provides an online practice platform for ABRSM Grade 5 Music Theory, accessible at app.owenmusictheory.com (the "Service"). By creating an account or using the Service, you ("you", "the user") agree to these Terms & Conditions. If you do not agree, please do not use the Service.

We are not affiliated with, endorsed by, or officially connected to ABRSM (Associated Board of the Royal Schools of Music). "ABRSM Grade 5" is used descriptively to indicate the syllabus our content is aligned with.

2. The Service

The Service offers practice questions covering the ABRSM Grade 5 Music Theory syllabus, in two modes:

A free tier is available with limited access. Full access requires a paid subscription.

We may add, remove, or change features, question content, or syllabus coverage at any time. We do not guarantee that the Service is free of errors, or that it covers every topic that may appear in the actual ABRSM exam.

You must provide accurate information when creating an account and keep your login details secure. You're responsible for all activity under your account, including subscription management.

4. Subscriptions & payment

Paid access is billed on a subscription basis at the price shown at checkout. Prices may change; we'll give reasonable notice before any change takes effect for existing subscribers. Subscriptions renew automatically until cancelled.

Cancellation

You can cancel your subscription at any time from your account settings. Cancelling stops future renewals — you'll retain access until the end of your current paid period, after which your account reverts to the free tier.

5. Refunds

First payment

When you first subscribe, you have 14 days from the date of that payment to cancel and receive a full refund, in line with your standard UK consumer cancellation rights for online purchases. To request this, contact us within the 14-day window.

Renewal payments

Renewal payments are non-refundable.

After your first 14 days, your subscription renews automatically at the end of each billing period. By subscribing, you acknowledge that each renewal payment is final and non-refundable once charged. This does not affect your right to cancel future renewals at any time as described in Section 4 — cancelling stops the next renewal from being charged, but does not refund a renewal that has already been processed.

If you believe you were charged in error (e.g. a duplicate charge or a billing malfunction), contact us and we'll look into it.

All questions, explanations, images, and other content on the Service are owned by us or our licensors and protected by copyright. Your subscription gives you a personal, non-transferable licence to use the content for your own study or teaching — it does not transfer ownership or grant any right to redistribute the content.

8. No guarantee of exam results

The Service is a study aid. We do not guarantee that using it will result in passing the ABRSM Grade 5 Music Theory exam or achieving any particular mark, and we are not responsible for exam outcomes.

9. Disclaimer & limitation of liability

The Service is provided "as is". To the fullest extent permitted by law, we exclude all warranties, express or implied, about the accuracy, completeness, or reliability of the content. We are not liable for any indirect or consequential loss arising from your use of the Service. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).

10. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll take reasonable steps to notify existing subscribers (for example, by email or a notice on the Service). Continued use after changes take effect means you accept the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections that apply in your country of residence.
